Fannie E. Chenoweth, the Republican candidate, was elected County Superintendent of Schools in Teton County, Montana in 1898. She was re-elected in 1900. In 1902 two people ran for the office, but emerged with an equal number of votes, resulting in a tie. County officials appointed Rebecca Acton, one of the candidates, to the position. Several court cases ensued, with the state of Montana supporting Chenoweth's right to remain in office. In 1904, the state supreme court ruled that there had been no one elected in 1902, therefore Chenoweth had a duty to remain in the office until such a person was elected.
