In 1902 two people ran for the office, but emerged with an equal number of votes, resulting in a tie. County officials appointed Rebecca Acton, one of the candidates, to the position. Several court cases ensued, with the state of Montana supporting Fannie E. Chenoweth's right to remain in office. Chenoweth had been elected in 1900.  In 1904, the state supreme court ruled that there had been no one elected in 1902, therefore Chenoweth had a duty to remain in the office until such a person was elected. It is not clear if Acton was elected in the 1904 race.
